Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Wasap.my platform operated by Wasap.my ("we", "our", or "us"), accessible at app.wasap.my. By registering an account or using our services, you agree to be bound by these Terms. If you do not agree, you may not use the platform.

1. Description of Service

Wasap.my is a WhatsApp marketing and communication platform that enables businesses to manage contacts, send broadcast messages, and automate customer communications via the Meta WhatsApp Business API. Use of this platform is subject to Meta's WhatsApp Business Policy in addition to these Terms.

2. Account Registration

  • You must provide accurate and complete information when registering.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must be at least 18 years of age to create an account.
  • One person or entity may not maintain more than one account without our prior written consent.
  • We reserve the right to refuse registration or cancel accounts at our discretion.

3. Acceptable Use Policy

You agree to use Wasap.my only for lawful business purposes. The following activities are strictly prohibited:

  • Gambling and online betting — promoting, operating, or facilitating any form of gambling, sports betting, online casino, or lottery services, whether licensed or unlicensed.
  • Illegal activities — any activity that violates applicable laws in Malaysia or any other jurisdiction, including but not limited to fraud, money laundering, and drug-related activities.
  • Spam and unsolicited messaging — sending messages to recipients who have not opted in or consented to receive communications from you.
  • Misleading or deceptive content — impersonating other individuals, brands, or organisations.
  • Harmful content — distributing malware, phishing links, or content that promotes violence, hate speech, or discrimination.
  • WhatsApp Policy violations — any use that violates Meta's WhatsApp Business Policy or Terms of Service.

We reserve the right to determine, at our sole discretion, whether any use of the platform constitutes a violation of this Acceptable Use Policy.

4. Subscription and Payments

  • Paid subscriptions (Monthly, Annual, or Lifetime) grant access to features as described in the respective plan at the time of purchase.
  • All fees are stated in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless stated otherwise.
  • Subscription fees are non-refundable except as explicitly stated in Section 5 below.
  • We reserve the right to change pricing with 30 days' notice. Price changes do not affect active subscription periods already paid for.
  • Lifetime plans grant access for the lifetime of the Wasap.my platform. We do not guarantee the platform will operate indefinitely.

5. Refund Policy

  • Monthly and Annual subscriptions: Refunds may be considered within 7 days of initial purchase if the platform is found to be materially non-functional. Requests must be submitted to support@wasap.my with supporting details.
  • Lifetime plans: All lifetime plan purchases are final and non-refundable.
  • Termination due to policy violations: Accounts suspended or terminated for violations of these Terms — including but not limited to Section 3 (Acceptable Use Policy) — are not entitled to any refund, regardless of the remaining subscription period or plan type.

6. Suspension and Termination

We reserve the right to suspend or permanently terminate your account, with or without prior notice, if:

  • You violate any provision of these Terms, including the Acceptable Use Policy.
  • Your use of the platform exposes Wasap.my, its users, or third parties to legal, regulatory, or reputational risk.
  • You provide false or misleading information during registration.
  • Required to do so by applicable law or regulatory authority.

Where feasible, we will provide prior notice via email before taking action. However, we may suspend access immediately in cases of serious or ongoing violations. Termination under this section does not entitle you to any refund.

7. WhatsApp Business API Compliance

Your use of Wasap.my to send messages via the WhatsApp Business API must at all times comply with Meta's WhatsApp Business Policy. You are solely responsible for the content of messages sent through the platform and for ensuring recipients have consented to receive your communications. We reserve the right to suspend accounts that receive disproportionate complaint rates, opt-out requests, or are flagged by Meta for policy violations.

8. Intellectual Property

All content, features, and functionality of the Wasap.my platform — including but not limited to software, design, logos, and text — are owned by Wasap.my and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the platform without our prior written consent.

You retain ownership of all content and data you upload to the platform. By using Wasap.my, you grant us a limited licence to process and store your content solely for the purpose of providing the service.

9. Limitation of Liability

To the fullest extent permitted by law, Wasap.my shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the platform.

Our total liability to you for any claim arising from the use of this platform shall not exceed the total fees paid by you in the three (3) months preceding the claim.

10. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. Scheduled maintenance and downtime may occur without prior notice.

11. Privacy

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice within the platform at least 14 days before taking effect. Continued use of the platform after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
